Pennsylvania Limits on Dauphin Mugshots

The Criminal History Record Information Act, or CHRIA, separately governs criminal-history information and dissemination. The most important current authority is the Pennsylvania Supreme Court’s 2025 decision in Mezzacappa v. Northampton County. The Court treated mugshots as identifiable descriptions and criminal-history-record information under CHRIA. It held that a county prison, as a non-law-enforcement criminal-justice agency, could not disseminate the photos in the manner requested. That ruling undercuts any blanket claim that a county-prison mugshot must be released under RTKL.

Dauphin County does not advertise an official chronological mugshot or recent-release gallery. The accurate route is to request a particular booking image and let the custodian apply current law. Dauphin Expungement and Photo Access

Expungement is a legal process that removes qualifying records under specified law and court authority.
